1. Disclosure of Health Certificates:

Certified medical practitioners and health & fitness experts with credentials from recognised institutions must disclose their status when sharing health-related information, promoting products, or making health-related claims. Transparency takes centre stage, allowing the audience to recognise the qualifications of the endorsers.

2. Clear Disclaimer for Health Experts:

Celebrities and virtual influencers positioning themselves as health experts must provide unambiguous disclaimers. These disclaimers underscore that their endorsements should not be considered substitutes for professional medical advice, diagnosis, or treatment. Encouraging the audience to consult healthcare professionals before significantly changing their diet, exercise, or medication routines is paramount.

3. Adequate Due Diligence:

Endorsers are mandated to conduct thorough due diligence before promoting any product or service. Preferably, they should utilise or experience the offering before endorsing it. False, misleading, or exaggerated claims must be avoided to ensure transparency and trustworthiness.

4. Scope of Disclosure:

The requirement for disclosure extends to endorsements, promotions, and instances involving health-related claims. Topics encompassing health benefits from food items, nutraceuticals, disease prevention, treatment, cure, medical conditions, recovery methods, and immunity enhancement fall under these regulations.

Celebrities assuming the role of health experts must differentiate between personal opinions and professional advice. Making specific health claims without credible evidence is cautioned against. Encouraging audiences to consult healthcare professionals for accurate medical advice is recommended.

7. Enforcement and Penalties:

The Department of Consumer Affairs will actively monitor and enforce these guidelines. Violations could lead to penalties under the Consumer Protection Act 2019 and other relevant legal provisions.

Influencers in the crucial categories of health and finance must now possess the qualifications and certifications to safeguard consumers from improper advice and ensure they are well-informed about associated risks. These qualifications must be transparently disclosed in their advertising posts.
